Purchase of Goods- Terms and Conditions
These terms and conditions apply to all purchase orders submitted to Nibav Lifts Pvt. Ltd., covering all purchase agreements that a consumer enters into with Nibav. We encourage you to read these terms and conditions in their entirety before submitting an order. These terms and conditions may be updated and vary from time to time, which is why we ask you to read the terms and conditions previous to every order you place with Nibav Lifts Pvt. Ltd.
A binding purchase agreement is entered into as soon as your order has been confirmed by us and an order confirmation has been sent from Nibav to the e-mail address or phone number you submitted. If manufacturing happens to get delayed, Nibav will notify you of this by e-mail or phone number. We may then suggest an alternative date, for delivery as early as possible. All drawings and site locations have to be verified by the customer before placement of the order.
Occasionally, there may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the Website is inaccurate at any time without prior notice (including after you have submitted your order). All prices quoted to you after any applicable discount will be final and cannot be modified after the placement of the order
Payment is possible in the currencies set out in the online payment window. Payment is currently made in INR for all transactions within India. Payment can be carried out by credit or debit cards, UPI, Netbanking or Smartcollect. Customers will also have to bear any additional service charges levied by the payment gateway ranging from 0.05% to 1.7% of the total value.
All shipping costs will be specified in the purchase order; so that the cost is clearly visible to you prior to completing the order. Civil work costs will be added against actual and will not be included in the final offer/Proforma Invoice unless requested by the customer for a turnkey service.
Packages returned as undeliverable and storage charges
If the item sent to you is returned as undeliverable, we reserve the right to charge you a fee covering the entire cost of the shipping and processing. This process will continue until the package is successfully delivered. Non-collected packages are normally not covered by the right to return items as well as the returned order. For additional delay in delivery, a storage charge of Rs.499+GST per day will be levied.
Delay in delivery and installation
Should your order be delayed, you will receive a message of this, including a new suggested time of delivery, at the latest within 60 days after you have submitted your order. You may not cancel the order if you do not accept the new suggested time of delivery but a delay in the delivery penalty of upto 5% can be discussed with Nibav Lifts Pvt. Ltd. If your order has been delayed, and the new suggested time of delivery has been accepted but the order has not yet been delivered within 30 working days after the new estimated time of delivery, you may always cancel the order by notifying our customer services team. If such a delay should occur, whereby you choose to cancel the order, we will repay the prepaid amount to you. If the order has already been dispatched you will have to return the ordered items in order to receive repayment. We will pay the cost of the return.
Collection and Use of Personal Data
Nibav India Pvt. Ltd. does not share any information collected regarding the customer with any third party. The information is only used internally to discuss our products, offers, purchase and delivery. Nibav Lifts Pvt. Ltd. has a legal duty to protect the confidentiality of taxpayer information. We take all reasonable steps to protect any information you submit via our websites, both online and offline, in accordance with relevant legislation in India. We take all appropriate steps to protect your personally identifiable information as you transmit your information from your computer to our sites and to protect such information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. We use technologies to safeguard your data and operate strict security standards to prevent any unauthorized access to it. Where you use passwords, ID numbers, or other special access features on these sites, you also have a responsibility to take reasonable steps to safeguard them.
Returns, cancellation and Refund Policy
All Nibav products are custom made are not eligible for any return, cancellation or refund in normal circumstances. For the return to be accepted under special circumstances, the returned items must be essentially in the same condition in which they were sold. In case, if you received a damaged product, it must be reported to us via email at Info@nibavlifts.com within 48 hours of delivery, with an image of the damaged product along with the packaging pictures. In case of Wrong Item/Wrong Colour/Wrong Size/Wrong Product is delivered; we will be helping you with a free return.
In case of returning the product, the customer needs to inform us within 7 days of receiving the order. If the product is delivered defective or damaged, the customer needs to inform us through email (firstname.lastname@example.org) within 48 hours. The supplied lift/part/item must be unused by the customer and all items must be returned in their original condition, with price tags intact, user manual, warranty cards, original accessories and in the original manufacturer’s box/packaging as delivered to you. An invoice should be available. A request for Reverse pickup will be initiated from our end. Once the pickup is arranged our courier partner will collect the product within 3 business days. After receiving the product, a quality check will be done over the product by our team which takes 2 working days. If the product is found damaged/defective by our team, We will try to arrange a replacement; however, it depends on the availability of the product. In some cases, where our Logistic Service Provider doesn’t provide a reverse pickup facility, the customer themself will have to send the product only through India post or any logistics agent to the below-mentioned address once the reverse pickup request is raised:

B. Cancellation Policy
The customer cannot cancel the order once the manufacturing has started.
- - Cancellation with 48 hours will be charged upto 25% of the Invoice value
- - Cancellation after 48 hours till the commencement of production will be charged at 50% of the Invoice value.
- - 100% of the invoice value will be charged once the production starts.
- - The customer then maybe charged for this event of unplanned cancellation post-approval from Nibav Lifts Pvt. Ltd. Unavailability of raw materials – in exceptional cases, if the raw material runs out of stock, the product delivery will be cancelled
C. Refund Policy
Our lifts are custom-made and are not eligible for a free refund. If the order gets cancelled due to unavoidable circumstances, the amount will be refunded to the customer based on the payment mode chosen by the customer at the time of placing the order. Credit/Debit Card/Net Banking/Wallets will take 2-4 business days. If the transaction is done through NEFT or Cheque, then the customer is expected to share the below-required details to our e-mail (email@example.com) from their registered e-mail address.
Account number, 2. Account Holder name, 3. IFSC Code
After receiving the required information for a refund, it will be processed in 2 business days and the same will reflect in your account in another 2-4 business days. For any EMI payment, the refund will be credited in 6-8 business days after cancellation.
Nibav Lifts Pvt. Ltd. ensures that all products are meticulously checked through our quality control procedures before being dispatched to our customers. We work hard to avoid the emergence of damages or defects in our products. Should you find that an item despite this is damaged or otherwise defective, we will replace your item with a new part of the item. If the item cannot be replaced, you will be refunded the original cost of the item and the return cost, unless the defect can be repaired. If the damaged item was part of an order containing other purchased items, the cost of the original delivery will not be refunded. You are asked to always examine your received products at the time of delivery and as soon as possible report any deviations from your order to us.
We will refund you as soon as possible, at the latest within 30 days from the date the returned item is received by Nibav, and we have established that the item is damaged or otherwise defective. Always save your receipt. The funds will be returned to your original method of payment. If you paid using your credit card, the amount will be repaid to the same card.
We cannot guarantee that the colors appearing on the website reflect the lift colors in reality. The colors can be reflected in different ways depending on your computer or phone screen, graphic card and computer settings.
The products sold are covered under the manufacturer’s warranty for 1 year which is extendable. In case you find that the product is not working properly after we have installed the lift, we will replace the desired part to your satisfaction, without any questions asked within Fourteen (14) days. The faulty product/part has to be returned back to us for replacement/repair. Transformers, Chargers and adaptors are not included in the warranty. Service plans and AMC plans can later be added to the product post-installation.
